Did he buy them alcohol or did someone buy it for him? More than likely thats the reason it was dropped, because he himself was of age to buy it. I would guess though, that even if they were "drunk" then still he couldnt be charged for it unless he brought it for them.
Again though, im sure he didnt make them drink against their will.
